1. Our approach
V-GAMES responds to notices of alleged copyright infringement that meet the requirements of the Digital Millennium Copyright Act (17 U.S.C. § 512). When we receive a complete notice, we act promptly to remove or disable access to the material it identifies. Games, artwork, names, and trademarks remain the property of their creators and publishers. See the Credits page for the projects V-GAMES uses.
2. What to include in a notice
To be valid, a notice must be in writing and include all of the following:
- The physical or electronic signature of the copyright owner, or of a person authorized to act on the owner’s behalf.
- A description of the copyrighted work you say has been infringed.
- The exact location of the material on V-GAMES, such as the page address (URL) or the name of the game, with enough detail for us to find it.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.
3. Where to send it
Email your notice to vgamesplaynow@gmail.com with the subject line “DMCA notice”. Please use this address only for copyright notices and counter-notices.
4. What we do
We review each notice, usually within a few days. If it is complete, we remove or disable access to the identified material and, where we can, let the person who supplied it know. We may ask for more details if something is missing, and we may not act on a notice that is incomplete. A copy of your notice, including your contact details, may be shared with the person who supplied the material.
5. Counter-notice
If material was removed and you believe that was a mistake or that you have the right to use it, you may send a counter-notice to the same email address. It must include:
- Your physical or electronic signature.
- A description of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed because of a mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, if you are outside the United States, any judicial district where V-GAMES can be found), and that you will accept service from the person who sent the original notice.
If we receive a valid counter-notice, we will pass it to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days.
6. Repeat infringers
Where people can post content on V-GAMES, such as chat or profile pictures, we will suspend or remove the accounts of people we determine to be repeat infringers.
7. False claims
Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing, or that material was removed by mistake, can be held liable for damages, including costs and attorney’s fees. Please make sure your notice or counter-notice is accurate.
8. Content on other websites
V-GAMES also links to and loads content from other websites, and its built-in proxy lets visitors open sites that V-GAMES does not host. We can only remove what we host or link to. For material on another website, please contact that website’s owner or hosting provider. See also our Terms of Use.
